Postseason Rally presented by Bank of America

Come celebrate the Dodgers' National League West Division Championship this Sunday night, September 28 at 6:00 p.m. at Dodger Stadium. We'll have music, food and former Dodgers on hand to welcome the NL West Division Champs back from San Francisco, and cheer them on before their postseason run. Admission to the postseason rally is free!
Admission and parking to the postseason rally is free! The event will also feature $2 Dodger Dogs and special pricing on soft drinks, peanuts and nachos.
Bank of America, the official bank of the Los Angeles Dodgers, will determine the "Fan of the Rally," who will win four tickets to one game of the 2008 National League Division Series*.
The Sunset gate and turnstiles at Dodger Stadium will open at 5:00 p.m., and merchandise commemorating the title and the 50th Anniversary will be on sale.

LOS ANGELES DODGERS AND BANK OF AMERICA'S 2008 FAN OF THE GAME CONTEST
OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR TO WIN. In conjunction with the Rally Playoff Festival (the "Rally") to be held on September 28, 2008 (the "Rally Date") inside Dodger Stadium, Los Angeles Dodgers LLC (the "Dodgers") and Bank of America Corporation ("Bank of America," and together with the Dodgers, the "Sponsors") are offering Los Angeles Dodgers fans the opportunity to compete in the 2008 Fan of the Game Contest (the "Contest").
1. HOW TO ENTER: To enter the Contest, enter Dodger Stadium between 5:00 P.M. and 6:30 P.M. on the Rally Date dressed in Los Angeles Dodgers clothing, and register as a participant. Upon registration, each participant will be sat with other participants at Dodger Stadium and receive an individually numbered wristband from the Sponsors and have the opportunity to participate in the Contest, as described in Section 4, below. The wristbands will be used to identify participants. Each participant must wear his/her wristband throughout his/her participation in the Contest. If a participant's wristband is lost or damaged such that the number is no longer distinguishable, such participant will be disqualified; a duplicate wristband will not be provided.
2. ELIGIBILITY: Participants must be legal residents of the state of California at the time of registration to enter. Employees of the Sponsors and their respective affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising or promotion agencies, and any individuals engaged in the development, production, or distribution of the Contest materials, and the immediate families and household members of any of the above are not eligible to enter the Contest.
3. PRIZE: One (1) prize (the "Prize") will be awarded. The Prize consists of four (4) Reserve Level tickets to Game 3 of the National League Division Series to be held at Dodger Stadium on October 4, 2008 (Approximate Retail Value: $140.00). No substitutions of the Prize, including cash substitutions, by the "Winner" (as defined in Section 4, below) will be allowed. Seat locations shall be determined by the Dodgers at their sole and absolute discretion. All expenses associated with the Prize that are not listed above, including, but not limited to, transportation, meals, and incidentals, are the sole responsibility of the Winner. All federal, state, and local taxes apply. The Winner shall be solely responsible for reporting and paying any and all taxes associated with the Prize. The Sponsors reserve the right to substitute the Prize with another of similar value and/or quality.
4. SELECTION OF WINNERS: Each participant will be judged using the criteria listed herein. The Winner will be selected by a panel of judges acting under the supervision of the Sponsors. The panel of judges will be selected by the Sponsors at their sole and absolute discretion. The Contest will consist of two rounds: the "First Round" and the "Final Round" (each, a "Round").
The First Round will take place between 6:30 P.M. and 7:00 P.M. During the First Round, each registered participant will have the opportunity to participate in the Contest and to be judged by the Sponsors' panel of judges based on two (2) criteria: (i) most Los Angeles Dodgers' clothing and gear worn by the participant (50%); and (ii) most team spirit that the participant exudes as a Los Angeles Dodgers fan (e.g., shouting "Go Dodgers!") (50%). Each participant will receive a score from one (1) to ten (10) by each judge for the above criteria -- a score of one (1) is the lowest possible score and a score of ten (10) is the highest possible score. The average of the judges' scores for each participant will be assessed, and the five (5) participants with the highest average score will be selected as finalists and invited to participate in the Final Round. In the event of a tie, the tied participants will be selected as finalists and invited to participant in the Final Round (i.e., it is possible for more than five (5) participants to participate in the Final Round, so that no tie-breaker is necessary during the First Round).
At or about 7:00 P.M. on the Rally Date (or such other time as is designated by the Sponsors and announced on the public address system at the Rally), the finalists will be required to appear on the Rally stage to participate in the Final Round. On the stage, each finalist will be judged by the panel of judges based on three (3) criteria: (i) most Los Angeles Dodgers' clothing and gear worn by the participant (33%); (ii) most team spirit that the participant exudes as a Los Angeles Dodgers fan (e.g., shouting "Go Dodgers!") (33%); and (iii) showmanship in his/her ability to generate enthusiasm from the crowd (e.g., loudest applause from the crowd) (34%). In the event of a tie, the score for showmanship will break the tie. Each finalist will receive a score from one (1) to ten (10) by each judge for the above criteria -- a score of one (1) is the lowest possible score and a score of ten (10) is the highest possible score. The average of the judges' scores for each finalist will be assessed, and the finalist with the highest average score will be selected as the "Winner" of the Contest, and awarded the Prize.
All judging will occur on the Rally Date at the end of each Round. The Winner will be notified on the stage immediately following the conclusion of the judging at the end of the Final Round. The Dodgers shall not be responsible for a Winner's failure to receive the notice that he/she has been selected as a Winner. If a Winner is ineligible to receive a Prize for any reason, the Prize will be forfeited and the next highest scored participant shall be awarded the applicable Prize and/or invited to participate in the subsequent Round of the Contest, if practicable.
5. CONDITIONS OF PARTICIPATION: By participating in the Contest, each participant accepts and agrees to be bound by all of the terms and conditions set forth in these Official Rules and any decisions made by the Sponsors in accordance with or pursuant to these Official Rules, which decisions shall be final and legally binding. The Sponsors and their respective affiliates, employees, agents and representatives are not responsible for printing or typographical errors in any Contest-related materials; late or misdirected registrations, and/or lost or damaged wristbands. If, in the Sponsors' exclusive judgment, this promotion becomes compromised in any way, the Sponsors reserve the right to withdraw the promotion offer, to void any registrations submitted fraudulently, or to select a Winner from all eligible registrations received prior to act that compromised the promotion. Personal information (e.g., name, address, and telephone number) collected from participants will be used for Contest purposes only.
Each participant assumes all risk of loss, damage, destruction, delay, or misdirection of Contest materials. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Sponsors or their agents. The Sponsors shall have the sole right to disqualify any participant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion.
The Sponsors (i) make no warranty, guaranty or representation of any kind concerning any Prize, (ii) disclaim any implied warranty, and (iii) are not liable for injuries, losses or damages arising out of any person's participation in the Contest or the acceptance and use of any Prize and travel thereto or therefrom. By participating in the Contest, each participant agrees, to the fullest extent permitted by law, to indemnify, release, forever discharge, and hold harmless, and covenants not to sue, the Sponsors and their respective owners, stockholders, directors, officers, employees, agents, representatives, successors, heirs, and assigns, and each and every person acting by, through, under or in concert with them, or any of them (hereinafter individually and collectively referred to as the "Indemnified Parties"), of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, damages, liability, lost cost or expense, of any nature whatsoever, known or unknown, fixed or contingent which the participant may have or hereafter have against the Indemnified Parties by reason of any damages, loss, or injuries sustained by the participant, whether to his/her person and/or property, as a result of or incident to the negligent acts or omissions of the Indemnified Parties in conducting the Contest and/or of participating in the Contest or in the acceptance or use of the Prize awarded.
Each Winner will be required to sign and return an Affidavit of Eligibility and Release after being notified of his/her selection as a Winner or the Prize will be forfeited. By accepting the Prize, the Winner agrees that the Sponsors shall have the right, where permitted by law, to use the Winner's name, voice, and likeness, and any photographs, films, or recordings made thereof, in any manner, at their sole discretion, worldwide, in perpetuity, for advertising or promotional purposes (including, without limitation, display on the video display board at Dodger Stadium during baseball games and/or special events) without having to pay any compensation to the Winner for such use.
As a condition of entering the Contest, each participant agrees that: (1) under no circumstances will the participant be entitled or permitted to obtain awards for, and participant expressly waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than actual, out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims, causes of action, and liability arising out of or connected in any way with this Contest and/or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event shall attorney's fees be recoverable by either party.
6. WINNER'S LIST: A list of the Winners will be kept on file at Dodger Stadium for one (1) year after the conclusion of the Contest. For a Winners' list, please send your request in writing to Los Angeles Dodgers LLC, 2008 Fan of the Game Contest Winners' List, Public Relations Department, 1000 Elysian Park Avenue, Los Angeles, California 90012. Requests must be postmarked by not later than December 15, 2008.
7. SPONSORS: The sponsors of this Contest are the Dodgers and Bank of America.
