Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. K-EARTH 101's "Dodger National Anthem Challenge" (the "Contest") is void where prohibited by law, rule, or regulation, where taxed, or where required to be licensed. The object of the Contest is to submit a video recording of a solo vocal performance of the "Star Spangled Banner" (the "National Anthem"). The Contest is sponsored by Los Angeles Dodgers LLC ("Dodgers"), and KRTH-FM, a radio station owned and operated by CBS Radio, Inc. ("K-Earth", and together with Dodgers, individually and collectively referred to as "Sponsor").

The Contest is open only to legal residents of California who are thirteen (13) years of age or older at the time of entry (each, an "Entrant"), with a valid Internet e-mail address as of February 24, 2008. Entrants who are thirteen (13) years of age or older, but not yet eighteen (18) years of age, must have the consent of a parent or legal guardian in order to enter. Employees, officers and directors (including immediate family members, and members of the same household, whether or not related) of Dodgers, K-Earth, the "MLB Entities" (as defined immediately below), and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions and Major League Baseball International), the Major League Baseball Clubs, SportsOnEarth, LLC,, Inc. and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities.

The Contest entry period runs from February 25, 2008 at 9:00 A.M. Pacific Time ("PT"), through March 11, 2008 at 11:59 P.M. PT (the "Entry Period").

To enter the Contest, each Entrant should complete the following four (4) steps:

Step 1: Register for the Contest by: (i) going to the Contest home page located at during the Entry Period; (ii) filling out a Contest "Entry Form," including the Entrant's name, e-mail address, date of birth, telephone number, and zip code; and (iii) submitting the Entry Form to Sponsor by clicking on the "Submit" button on the Contest home page. Entrants who are thirteen (13) years of age or older, but not yet eighteen (18) years of age, must have a parent or legal guardian fill out and submit the Entry Form on behalf of the Entrant.

Step 2: Print the Entry Form confirmation page.

Step 3: Create a video recording of Entrant's solo performance of the National Anthem (the "Video"). The Video must contain only one (1) performance of the National Anthem and must be submitted in one of the following formats: VHS Tape or DVD. Only original, unpublished, solo performances (i.e., no duet or group performances) will be accepted.

Step 4: Mail the Video and the printed Entry Form confirmation page (collectively, the "Entry") to:

Participant's Entry must be postmarked by March 11, 2008, and received by Dodgers on or before 5:00 P.M. PT on March 17, 2008. All Entry materials, including all Videos, will not be returned.

While registering for the Contest at, Entrants will be given the option to receive commercial e-mails from Dodgers; however, eligibility to participate in the Contest is not dependent upon Entrant's consent to receive such e-mails. All information submitted by Entrants is subject to's Privacy Policy accessible at: Each Entrant must complete all non-optional data requested on the Entry Form. Incomplete Entry Forms shall be void. Limit one (1) Entry per person.

There will be two (2) rounds of Contest judging: the "Initial" round and the "Finalist" round.

Initial Round:
A panel of Dodgers' judges will judge all Video performances validly submitted during the Entry Period, based on the following four criteria:
    Vocal Range and Quality - 25%
    Showmanship and Stage Presence - 25%
    Accuracy and Clarity of Lyrics - 25%
    Overall Quality of Performance - 25%
Upon the conclusion of the Initial Round judging period, the three Entrants with the highest combined total scores will be deemed the three (3) Contest "Finalists." In the event of a tie, the score for Vocal Range and Quality will be used as the tiebreaker.

On or about March 18, 2008, Sponsor shall contact the three (3) Finalists and notify them that they have been selected to move on to the Finalist round. Entrants who are not selected as Finalists by Sponsor will not be contacted.

Finalist Round: The Finalist round will begin at 9 a.m. PT on March 20, 2008 and continue to 11:59 p.m. PT on March 26, 2008. During the Finalist round period, users of Dodgers' official website,, will be able to visit the Contest home page at, view each of the Finalists' Video performances, and vote for their favorite.

The Finalist who has earned the greatest number of online votes at the conclusion of the Finalist round period (11:59 p.m. PT on March 26, 2008), as determined by Sponsor and MLBAM in their sole discretion, will be deemed the Contest "Winner" and will be awarded the "Grand Prize," as defined below.

The "Grand Prize" shall consist of the following:

1. The opportunity to sing the National Anthem at Dodger Stadium prior to the home game to be played by the Los Angeles Dodgers baseball team and the San Francisco Giants baseball team on April 1, 2008 ("Opening Night"); and
2. Four (4) Field Level seat tickets and one (1) parking pass to the Opening Night home game.

The estimated retail value of the Grand Prize is Four Hundred Dollars ($400.00). The Grand Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole discretion. There will be no substitutions for the Grand Prize except by Sponsor who reserves the right to substitute a prize of comparable or greater value at its sole discretion.

The Grand Prize Winner is solely responsible for any and all applicable federal, state and local taxes (including income and withholding taxes), and all costs and expenses associated with the acceptance and use of the Grand Prize not specified herein as being provided by Sponsor, including but not limited to, costs and expenses related to lodging, transportation, meals, taxes (including income taxes), and gratuities. Limit one (1) prize per person, family or household. Major League Baseball game dates and times are determined in the sole discretion of the Office of Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner agrees to comply with all applicable stadium regulations in connection with the Grand Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to Winner and/or any of Winner's guests who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Opening Night home game. The "Released Parties" (as defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of Major League Baseball games.

Dodgers will be solely responsible for resolving any disputes and/or rule violations that arise in connection with the Contest. All decisions by Dodgers regarding the Contest shall be final and binding in all respects.

By entering the Contest, each Entrant (and the parent or legal guardian of a minor Entrant) agrees (i) that the Entrant's submission is an original work of authorship and the Entrant owns all right, title and interest in the Entry as of the date of submission; and (ii) to assign all right, title, and interest, including copyright rights, in the Entry to Sponsor, and to grant permission for Sponsor and MLBAM to publish or publicize all or part of their Entry, including, but not limited to, Entrant's name, likeness, and Video performance, in whole or in part, for advertising, promotional and trade purposes in conjunction with this and similar promotions in any and all media now known or hereafter developed, in perpetuity, without notice and without further compensation, except where prohibited by law.

The potential Winner will be notified by e-mail and/or telephone by Sponsor and/or MLBAM and may (in Sponsor's sole discretion) be confirmed by postal mail, return receipt (the "Prize Notification") on or about March 27, 2008. In the event that the potential Winner does not respond to such Prize Notification within one (1) day of the date of notification, a disqualification will result and an alternate potential Winner will be chosen from among all remaining eligible Entries. The potential Winner will be required to execute and return an Affidavit of Eligibility and Release of Liability, and, unless prohibited by law, Publicity, within one (1) day of the date of receipt. A disqualification will result and an alternate potential Winner will be selected from among all remaining eligible Entries if all required documents are not properly executed and returned within the specified period of time. The potential Winner's refusal to submit such documents to Sponsor, the return of such documents to Sponsor as non-deliverable, or the potential Winner's noncompliance with these Official Rules, will result in disqualification and cause an alternate Winner to be chosen from among all remaining eligible Entries.

By participating in the Contest, each Entrant (and the parent or legal guardian of a minor Entrant) accepts and agrees to be bound by these Official Rules (including all eligibility requirements herein), the Privacy Policy, and the Website Terms of Use. An Internal Revenue Service 1099 form will be issued to any winner of a prize having a retail value greater than Six Hundred Dollars ($600.00).

All applicable federal, state, provincial, and local laws and regulations shall apply to the Contest. This Contest and these Official Rules will be governed by the laws of the State of California. As a condition of entering the Contest, each Entrant (and each parent or legal guardian of a minor Entrant) agrees that: (i) under no circumstances will the Entrant (and the parents or legal guardian of a minor Entrant) be entitled or permitted to obtain awards for, and Entrant (and each parent or legal guardian of a minor Entrant) expressly waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than actual, out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (ii) any and all disputes, claims, causes of action, and liability arising out of or connected in any way with the Contest and/or the Grand Prize shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the rules of the American Arbitration Association; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event shall attorney's fees be recoverable by either party.

Sponsor, the MLB Entities, and their respective parent companies, trustees, subsidiaries, franchisees, assignees, affiliates, licensees, agents, independent contractors, and advertising and promotional agencies, and each of their respective general and limited partners, members, shareholders, officers, directors, agents, employees, representatives and contractors (collectively, the "Released Parties") shall not be responsible for lost, late, stolen, garbled, delayed, undelivered, or misdirected Entries, for incorrect, inaccurate or incomplete Entry information whether caused by an Entrant, equipment, or technical malfunction, or for any human error, technical error or malfunctions.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with the Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of the Contest, the processing of entries, selections or registrations, the tabulation of scores, the cancellation of games or any errors appearing in any Contest-related materials, including, but not limited to, errors in advertising, these Official Rules, the selection and announcement of the Grand Prize winner, or the distribution of the Grand Prize. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

Released Parties make no warranties, express or implied, relative to the use or enjoyment of the Grand Prize or any portions thereof, including, without limitations, its quality, merchantability, or fitness for a particular purpose. By entering the Contest, each Entrant (and the parent or legal guardian of a minor Entrant) agrees to indemnify, hold harmless, and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by Entrant's participation in the Contest, Entrant's Entry, or Entrant's acceptance, possession, quality, use, or misuse of the Grand Prize, or any portions thereof, including any travel or activity related thereto.

The Contest is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling.

If for any reason the Contest is not capable of being run as planned, including because of any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and, if cancelled, to determine the Winner, if any, from among all eligible, non-suspect Entries received by Sponsor up to the point of cancellation.

Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to, or resulting from, participation in the Contest or downloading any materials related to the Contest.


All Entries must include a valid e-mail address for the Entrant. In case of multiple Entries received from the same Entrant, only the first Entry received from such Entrant will be considered. In the event of dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning Entry will be deemed made by the "Authorized Account Holder" of the e-mail address submitted at the time of entry, provided such Authorized Account Holder is eligible according to these Official Rules. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.

In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify Entrants residing in any affected geographic areas. In such event, the Released Parties shall have no liability to any Entrants who are disqualified due to such an action.

A record of the winning Entry and the odds of winning will be kept on file by Dodgers for a period of one (1) year after the conclusion of the Contest.
