The Sweepstakes is open to legal residents of California who are eighteen (18) years of age or older at the time of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsors, the "MLB Entities" (as defined immediately below), each of the Sponsors' and MLB Entities' respective affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, are not eligible to participate. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Tickets.com, Inc., SportsOnEarth, LLC, the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. The Sweepstakes is void where prohibited or restricted by law, taxed, or required to be licensed.
HOW TO ENTER: The Sweepstakes consists of eight (8) separate "Drawings" to be conducted in accordance with the provisions of the "Random Drawings" section of these Official Rules, below. Each Drawing has its own "Entry Period" and "Prize" (as set forth in the "Prizes" section of these Official Rules, below). Each eligible person desiring to enter a Drawing (an "Entrant") may enter as many separate Drawings as he or she wishes and in which he or she is eligible to compete. Entries submitted during an Entry Period shall only be valid for the Drawing corresponding to such Entry Period. There are two ways to enter each Drawing: via text message or via mail. No other method of entry will be accepted. All entries become the property of the Sponsors and MLBAM and will not be retuned. The Sponsors will not acknowledge receipt of entries.
(A) Text Message Method (for AT&T subscribers): To submit an entry via the Text Message Method, Entrant must be an AT&T service subscriber with text messaging functionality. During any valid Entry Period, such Entrant may submit an entry by sending the text message "BLUE" via Entrant's wireless phone to short code 6521. Entrant will be charged standard text message fees for each text message sent from Entrant's phone according to the terms of Entrant's service agreement with AT&T. Entrant should check phone capabilities for specific text messaging instructions.
(B) Mail-in Method: If an Entrant is not an AT&T service subscriber or does not wish to enter via text message, an Entrant may enter a Drawing by printing his or her name, address, city, state and zip code, day & evening telephone number, and email address (optional) on a standard size postcard and mailing the postcard to: Think Blue Text Message Sweepstakes, 1000 Elysian Park Avenue, Los Angeles, California 90012. The Sponsors will use email addresses provided via the Mail-in Method for Prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon Entrant's providing this information. In order to be eligible for a Drawing, mail-in entries must be postmarked within the applicable Entry Period and received by Dodgers within five (5) business days after the close of the Entry Period. Proof of mailing does not constitute proof of delivery.
RANDOM DRAWINGS: The "Winner" of each Drawing will be selected by random drawing from all eligible entries received by the Sponsors during the applicable Entry Period for such Drawing. Each Drawing will take place on or about eight business (8) days after the close of the applicable Entry Period. The decisions of the Sponsors shall be final and binding regarding all matters relating to this Sweepstakes, including, without limitation, the selection of the potential Winner(s). Each Winner is fully responsible for any and all applicable international, federal, state, and local taxes (including income and withholding taxes) related to his or her Prize. TRANSPORTATION IS NOT INCLUDED. All costs and expenses associated with the acceptance and use of a Prize not specified herein as being provided, including, but not limited to, lodging, transportation costs, meals, and gratuities and other expenses incurred by accepting such Prize, are the sole responsibility of the Winner of such Prize. Winner's guests must be of the legal age of majority in their jurisdictions of residence, unless traveling with a parent or guardian, as applicable. Each Winner shall comply with all applicable stadium regulations in connection with his or her Prize, as applicable. The Sponsors and the applicable MLB Entities reserve the right to remove or to deny entry to the stadium to Winner and/or any of Winner's guests who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at a game, as applicable.
MLB game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Sponsors, as applicable, and may be subject to change. The terms and conditions of any tickets awarded as a Prize hereunder will govern in the event that a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason beyond the reasonable control of the Sponsors and/or the MLB Entities.
Each Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at the Sponsors' sole discretion. There will be no substitutions for any Prize by any Winner. The Sponsors reserve the right to substitute a prize of comparable or greater value at their sole discretion.
The Released Parties (as defined in the "Waiver of Liability/Publicity Release" section, below) will not be responsible for any acts of God, acts of terrorism, civil disturbances, work stoppages, natural disasters, or any other acts, events or occurrences outside their reasonable control that may cause the cancellation of MLB games.
NOTIFICATION: Each potential Winner will be notified by text message, email, and/or telephone by the Sponsors. In the event that a potential Winner does not respond to any such notification within forty-eight (48) hours of the time of such notification, a disqualification will result and an alternate potential Winner shall be chosen from among all remaining eligible entries. The Sponsors will notify the alternate Winner via text message, email and/or telephone, after which the alternate potential Winner must reply and accept the Prize within forty-eight (48) hours of the time of notification. If any potential Winner fails to respond within forty-eight (48) hours of the time of notification, or if the notification is returned as undeliverable, then the potential Winner will be deemed ineligible, the Prize will be forfeited, and Sponsors will choose another alternate potential Winner by random drawing from among all remaining eligible entries for the applicable Drawing. This procedure shall continue, if necessary, until the Prize is awarded.
Unless prohibited by law, each Winner will be required to execute and return an "Affidavit of Eligibility and Release of Liability" within two (2) days of the date of receipt. A disqualification will result and an alternate potential Winner will be randomly selected from among all remaining eligible entries for the applicable Drawing if all required documents, including, without limitation, the Affidavit of Eligibility and Release of Liability, are not properly executed by the Winner and returned within the specified period of time. Refusal or return of such documents as non-deliverable or the Winner's noncompliance with these Official Rules will result in disqualification and cause an alternate potential Winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, each Entrant agrees (i) to be bound by these Official Rules, including all entry requirements, and (ii) to waive any and all claims against the Sponsors, the MLB Entities, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, the "Released Parties") for any injury, damages or losses that may occur, directly or indirectly, in whole or in part, from Entrant's participation in the Sweepstakes or from Entrant's receipt or use of any Prize and/or any travel or activity related to the receipt or use of any Prize, and each Entrant grants to the Released Parties the right to use, reproduce, and publicize such Entrant's name, voice, and likeness, and any photographs, films, or recordings made of Entrant, in any manner whatsoever, at the Sponsors' and/or any MLB Entity's discretion, including, without limitation, for advertising, promotional, or trade purposes in conjunction with this and similar promotions, in any and all media now known or hereafter developed, worldwide, in perpetuity, without notice and without further compensation or consideration to Entrant, except where prohibited by law.
GENERAL CONDITIONS: Released Parties are not responsible for printing or typographical errors in any Sweepstakes-related materials, stolen, late, lost, damaged, garbled, delayed, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Released Parties are not responsible for incorrect, inaccurate transcriptions, loss or delay of any entry or Prize reply information, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsors' and/or MLBAM's exclusive judgment, this Sweepstakes becomes compromised in any way, the Sponsors and/or MLBAM reserve the right to cancel the Sweepstakes or withdraw the Sweepstakes offer, cancel any method of entry, void any entries submitted fraudulently, or select the Winner(s) from all eligible entries received prior to the act that compromised the Sweepstakes.
Persons who tamper with or abuse any aspect of the Sweepstakes or who are in violation of these Official Rules, as solely determined by the Sponsors, will be disqualified, and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsors, the MLB Entities, or their respective agents. The Sponsors shall have the sole right to disqualify any Entrant for any violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. The Released Parties (i) make no warranty, guarantee or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty. All disputes will be resolved in accordance with the laws of the State of California and any applicable federal law without regard to choice of law rules or principles.
The Sponsors and/or the applicable MLB Entities reserve the right, in their discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, the Sponsors may elect to identify Winner(s) and award Prize(s) by way of random drawing from among all non-suspect, eligible entries received by the Sponsor up to the time of such cancellation.
In the event of dispute as to the identity or eligibility of a Winner based on the phone number that a text message was sent from, the winning entry will be declared made by the "Authorized Account Holder" of such phone number at the time of the entry.
