DIGITAL DRIVE TO MALIBU SWEEPSTAKES
Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASES DO NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. No purchase or payment of any money is necessary to enter. SWEEPSTAKES PERIOD: The Digital Drive to Malibu Sweepstakes ("Sweepstakes") begins at 12:01 AM Pacific Time on May 24, 2008 and ends at 11:59 PM Pacific Time on September 7, 2008 ("Sweepstakes Period"). SPONSOR: General Motors Corporation, 100 Renaissance Center, Detroit, Michigan 48265. ADMINISTRATOR: All Terrain Productions, Inc., 2675 West Grand Avenue, Chicago, Illinois 60612-1144. AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, all entrants fully and unconditionally agree to and accept these Official Rules and the Sponsor's and Administrator's decisions which are final and binding in all matters related to the Sweepstakes. Winning the prizes (described below) is contingent upon fulfilling all requirements set forth herein. PRIZES AND THE VALUE OF THE PRIZES. One CHEVROLET MALIBU automobile (valued at no more than $23,000.00) will be awarded. HOW TO ENTER: There are two (2) ways to enter the Sweepstakes by mail or on line:
B. On-Line Entry. During the Sweepstakes Period, go to www.dodgers.com/malibu to access the on-line entry form for the Sweepstakes. By successfully transmitting your completed on-line entry form as directed, you will be entered in the Sweepstakes. All information submitted on line by entrants is subject to, and will be treated in a manner consistent with, Dodgers.com's Privacy Policy accessible at: http://losangeles.dodgers.mlb.com/la/help/la_help_about Privacy.jsp. Entrants must fully complete and submit all non-optional data requested on the on-line entry form to be eligible. Incomplete entries are void. On-line entrants to the Sweepstakes will be given the option to receive commercial e-mails from Sponsor or Dodgers.com or both. However, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails. C. Limit: One (1) entry per person regardless of method of entry used. ODDS OF WINNING. Odds of winning will depend upon the number of eligible entries received from all entry methods. ELIGIBILITY. The Sweepstakes is open only to persons who, at the time of entry, are eighteen (18) years or older (except in the case of legal residents of any states where the age of majority is greater than eighteen (18) years of age, such age of majority) and legal residents of any of the fifty states except Florida, New York, and Rhode Island. Employees, directors and officers and their immediate families (husbands, wives, brothers, sisters, parents and children and their spouses) and household members (whether related or not) of Sponsor, Administrator, GM R*Works, and the MLB Entities and each of their respective parents, subsidiaries and affiliates, and any and all other companies involved in the implementation and execution of the Sweepstakes as otherwise associated with the Sweepstakes (collectively the "Sweepstakes Entities") are not eligible. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., ("MLBAM" or "MLB.com"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and Major League Baseball Productions and Major League Baseball International), the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC, and each of their subsidiaries or affiliated entities, any entity that, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. Each winner will be required to sign, have notarized and return an affidavit of eligibility and release and, where legal, a publicity release. All taxes, insurance, automobile title, registration, license and other associated fees, and additional or optional equipment, including but not limited to federal, state, local and income taxes and fees associated with acceptance of the prizes, are the sole responsibility of the winners, and they may be required to furnish appropriate tax documentation. All costs and expenses associated with acceptance and use of the prize not described herein as being provided, including but not limited to transportation costs, lodging, meals, and other expenses incurred by accepting the prize are the sole responsibility of the winners. WINNERS' LIST. For the names of the winners, please send a self-addressed and stamped envelope to "Digital Drive to Malibu" Sweepstakes, 2675 West Grand Avenue, Chicago, Illinois 60612-1144. Requests for winners' names must be received by December 1, 2008. Allow four to six weeks for delivery of the list. GENERAL PRIZE RESTRICTIONS. The prize is subject to availability and is subject to change. The prizes may not be transferred or assigned. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute the prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion. The winners will be responsible for (i) travel to and lodgings and meals in Los Angeles for the drawing on September 19, 2008, and the costs thereof, and (ii) all applicable taxes (not limited to federal, state, local and/or income). Each winner will be required to provide his or her Social Security number for tax reporting purposes. Sponsor will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of any prize. GENERAL CONDITIONS AND RELEASE. By participating, each entrant (a) agrees to release Sweepstakes Entities, and each of their respective parents, affiliated companies, subsidiaries, directors, officers, agents, employees, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives from any and all liability for any claims, costs, injuries, losses or damages of any kind that may occur, directly or indirectly, in whole or in part, caused by their participation in this Sweepstakes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize except where prohibited by law; (b) consent to the use by Sponsor, the MLB Entities and each of their respective designees of the winners' names, hometowns, photographs, voice or other likenesses, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media now known or hereafter devised, throughout the world without additional consideration, notification or permission, unless prohibited by law; and (c) acknowledge that the Sweepstakes Entities have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability. Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost or delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to an entrant's or any other person's computer related to or resulting from participation in this Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR AND THE APPLICABLE MLB ENTITIES RESERVE THE RIGHT TO DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH ENTRANT OR INDIVIDUALS TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Sweepstakes (or any portion thereof) is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes that in the opinion of Administrator, Sponsor, or the applicable MLB Entities corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes (or any portion thereof), Administrator and the applicable MLB Entities reserve the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes (or any portion thereof). In the event of any cancellation, termination or suspension, notice thereof will be posted at the Website and the determination of the prize winners will be made, from among all eligible, non-suspect entries received as of the date of such termination, cancellation or suspension, as Administrator determines in their sole discretion. Entries not complying with all rules are subject to disqualification. |
